- These Terms do not affect your statutory rights under the Sale of Goods Act, but are designed to clarify our policies and your rights and duties. Placing an order signifies that you agree to our terms and conditions of sale.
- These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Jenny and the Bead Stall and you relating to your purchase. We advise that you print off and keep safe a copy of these terms and conditions once your order has been accepted by enny and the Bead Stal. You are advised to read (and are responsible for reading) fully all information on this website.
- Jenny and the Bead Stall reserves the right at any time to modify, alter, amend or update these terms and conditions, and you agree to be bound by such modifications, alterations, amendments or updates.
- If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.
- No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.
- Product descriptions, sepcifications and imagery on our website is issued for the sole purpose of giving an approximate idea of the goods.
- Subject to the licence granted to you to use the Site, Jenny and the Bead Stall reserves all rights, title and interest in its Intellectual Property Rights in the Site. You may not reproduce, publish, transmit, distribute, display, modify, sell, or exploit in anyway, in whole or in part, any contents of the website for any purpose without the prior permission of Jenny and the Beadstall.
- Every purchase you make shall be deemed performed in the UK. English Law shall govern every aspect of contractual agreement concerning purchases made from the Site. The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction.
- While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
- Jenny and the Beadstall reserves the right to alter prices at any time, without prior notice.
- Jenny and the Bead Stall use Paypal and Google Checkout secure online payment methods. Once payment has been authorized, you will recieve an automatied email confirming your order.
- You undertake that all details you provide to Jenny and the Bead Stall for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
- All orders are subject to acceptance and to availability of the goods ordered. Jenny and the Bead Stall is entitled to refuse any order placed by you for any reason.
- No contract for the sale of any product will subsist between you and Jenny and the Bead Stall until payment has been received from you and confirmation of dispatch has been sent. We will confirm that payment has been received and the product(s) have been dispatched by a confirmation email. This confirmation e-mail amounts to an acceptance by Jenny and the Bead Stall of your offer to buy goods from Jenny and the Bead Stall (whether or not you receive that e-mail).
- This confirmatory e-mail will contain all relevant statutory information concerning your contract.
- The confirmatory e-mail will also contain a link to these terms and conditions, and may be amended in accordance with paragraph 3 above from time to time.
- If there are any changes to the details supplied by you it is your responsibility to inform Jenny and the Bead Stall as soon as possible.
- All orders will be sent using Royal Mail, and we aim to dispatch all goods within three working days. Our delivery charges are as follows:
- When goods are in stock please allow 5-7 working days for delivery. For Europe and Worldwide please allow 7-14 days for delivery.
- You will be notified within two working days if any goods ordered are out of stock. Within that period we will send you an email with an estimated time of delivery.
- Any time or date stated for delivery is an estimate only. We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
- For Christmas Deliveries, we recommend that you order by the 15th December. We will endeavour to dispatch all ‘in stock’ orders within 3 working days, however we cannot guarantee delivery on or before the 24th December as the post may be delayed in your area.
- Jenny and the Bead Stall does not add sales tax. If your delivery address is outside of the UK, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; we advise each customer to contact their local customs office for further information.
- Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.
- All purchases are non-exchangeable, non-refundable and non-transferable.
- You may cancel your order at any time prior to your order being processed by emailing cancellations@jennyandthebeadstall.co.uk ensuring that you quote your name, address and order reference number.
- You may withdraw from the contract at any time after the product has been dispatched and you have received our email confirming your order, but no later than 7 working days after the day after you receive the product , by:
- emailing cancellations@jennyandthebeadstall.co.uk ensuring that you quote your name, address and order reference number.
- returning the goods to Jenny and the Bad Stall unopened together with the original invoice. Jenny and the Bead Stall will refund you the purchase price of the goods. Where appropriate Jenny and the Bead Stall shall refund any additional customs duties borne by you on receipt of the relevant customs receipt.
- Once we receive notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited to Jenny and The Bead Stall from your account in relation to your order will be re-credited to that account as soon as possible and in any event within 30 days of your order provided that the goods you wish to return are received by Jenny and The Bead Stall in the condition that they were in when delivered to you. You will be liable for any charges incurred in returning the goods to Jenny and The Bead Stall.
- Jenny and The Bead Stall reserves the right to make a 15% restocking charge for any goods which are not returned in mint condition or to refuse to accept such goods, at its sole discretion. Jenny and The Bead Stall also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.
- In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Jenny and the Bead Stall shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify Jenny and the Bead Stall of the problem by e-mail to customerservices@jennyandthebeadstall.co.uk within 7 working days of recieving the goods and return the goods in question. This does not affect your statutory right.
- Jenny and the Bead Stall take all reasonable precautions to keep information supplied to us by customers strictly confidential. We do not supply our 'mailing information' to third parties. Information supplied to us may be stored on a computer system for our convenience.
- PayPal and Google Checkout secure transaction services are independent organizations and your credit card details are not divulged to us at any time.
